Product Terms and Conditions
Purchasing from Tesco – Please see Part A for all orders and purchases made for products sold by Tesco, including Tesco grocery products, and F&F clothing products sold on our website or mobile app, Whoosh and GetGo.
Purchasing from Marketplace Partners – Please see Part B for all orders and purchases made for products sold by Marketplace partners on Tesco Marketplace.
Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you ("Product Terms").
Part A – Purchasing from Tesco
Prices and VAT
Please note that except as set out below the prices are guide prices only. The actual price you pay will be the price charged in-store at the time your order is picked for delivery. The actual order value cannot be determined until the day of delivery because the prices stated on the website and app may vary either above or below the prices in-store on the day your order is picked and delivered.
Please note that for F&F clothing orders the actual price you pay will be the price charged at the time your order is placed. Once the order has been placed, you will not be able to amend the F&F clothing part of your order.
When your order is delivered you may return any item and receive a full refund if you are unhappy with the price charged or for any other reason.
All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rate specified when you place your order.
Certain promotions available in stores may not be available online, and there may be promotions available online that you won’t be able to find in-store.
Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. When an item you have ordered for grocery home delivery, Click+Collect or Whoosh is unavailable we will attempt to deliver a suitable substitute, unless you have asked us not to.
To ensure availability of all our products customers may be limited to a maximum number of items.
Acceptance
Your order is an offer to buy from us. A contract is only formed when we have despatched your order. At any point up until then, we may decline to supply the goods to you.
Tesco products are available for non-commercial and domestic use only. We reserve the right to refuse or cancel orders from businesses or that we consider are for commercial or other non-domestic concerns. Such orders may also result in cancellation of applicable Clubcard membership or points, in accordance with our Clubcard Terms and Conditions. You agree not to purchase Tesco products on a commercial basis and that you will be responsible for any customs clearance requirements, import declarations or tax consequences that may arise as a result of any such purchases.
Minimum Basket Charge
A minimum basket charge applies to grocery home delivery and Click+Collect.
If the value of the products in your basket when you confirm your order is less than the minimum basket value, then we will add a £5 charge to your order. We will add the charge to your total at the checkout page, before you pay. If you go back and change your order, so that the value of your order is greater than the minimum basket value, we will remove the charge.
The minimum basket value is £50 for grocery home delivery, and £25 for Click+Collect. There is no minimum basket value for F&F clothing purchases and F&F clothing items are not counted for the purposes of calculating the minimum basket charge for grocery home delivery and Click+Collect.
Unfortunately we can’t combine separate orders once we have processed them, so please make sure you make any changes to increase the value of your basket before you confirm your order.
You will earn Clubcard points on the minimum basket charge..
If we apply a charge to your shop, and we give you a refund for your entire shop, we will also refund the charge. However, we will not refund the charge if only some of the items in your shop are refunded.
Delivery
Delivery will be made to the address specified by you when you place your order.
To help keep you and our delivery drivers safe, they are following social distancing guidelines. This means they will keep a 2-metre distance from you and won't come into the property, unless it is one of the following exceptions.
If you are a vulnerable, disabled or elderly customer, you can ask our delivery drivers to take your shopping inside your home. They will do so, providing they believe it is safe and practical. Unfortunately, they won’t be able to enter your home if you are self-isolating.
For deliveries to a residential apartment block, we will generally deliver to the front door of your apartment. However, we reserve the right to deliver only to the main entrance of the property if the driver believes it is unsafe or not practical to deliver to your apartment front door.
For deliveries to a business address, delivery will only be made to the ground floor communal area/entrance.
Please note that we deliver goods only to specified regions within the United Kingdom. To check that the online Grocery service delivers to your area, please enter your postcode at https://secure.tesco.com/account/en-GB/register.
Delivery times will be agreed with you at the time of placing your order.
Please note that F&F clothing deliveries rely on third-party courier services network and does not deliver to Channel Islands and British Forces Post Office (BFPO), but covers the rest of the UK.
All goods must be signed for on delivery by an adult aged 18 years or over.
Tesco follows a "Think 25" policy when delivering age-restricted items, so if the person receiving the goods looks under 25, proof of age will be requested. If proof is not available and there is no one of that age at the address when delivery is being made, the goods will be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details).
In these circumstances, if we have to return to deliver the goods, a further charge may become payable provided that delivery is attempted at the agreed time.
Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
Delivery and Click+Collect order items will not be packed in carrier bags. For certain products, such as packaged raw meat, we’ll still need to use red hygiene bags. You can hand these back to the driver or the colleague at the collection point to be recycled.
Small, loose fruit and vegetables, such as loose apples, will be put into paper bags. Larger produce, like melons, will be placed directly into the tray without any bag.
F&F clothing orders are not available for Click+Collect and will incur delivery fees. Please note that Delivery Saver does not apply to F&F clothing deliveries. The F&F clothing orders will be fulfilled by a third-party courier service. The estimated delivery time on F&F clothing products is standard delivery (3-5 working days) and next-day delivery (1-2 working days). This is subject to courier availability and coverage.
If items from your F&F clothing order are out of stock, you will be notified, and your order will be adjusted accordingly.
Click & Collect
If you choose to collect your order from a store, the time slot and store for collection will be agreed with you when you place your order. In select stores, same day Click+Collect is available, charges apply.
Please note that you will be unable to collect your order earlier than the agreed time slot. Should you arrive late, you may still be able to collect your order - please speak with the member of our staff at the dedicated collection point who will be able to assist you.
Please bring your order number and the credit card you used to pay for your order (we will not be able give you your order unless you produce an appropriate form of I.D.)
Returns and Refunds
We'd like you to be happy with everything you purchase from Tesco. Please see our Returns and Refunds Policy for details of how to obtain a replacement or refund. Our refund policy is in addition to and does not affect any of your legal rights. The simplest ways to return your items are set out in the policy.
Please note that for F&F clothing orders that are returned via courier, you will be charged a fee of £2.50 and this will be deducted from the amount you are refunded. You will be responsible for generating the return label online. Refunds will be processed after goods are received and inspected at the depot. You can only return F&F clothing orders if the items are unworn, unwashed and have the original tags attached.
If you have any complaints about an online purchase, please get in touch and we will do our best to help. If you are still not happy, the European Commission has set up an online service to resolve disputes about online transactions. Please visit the Online Dispute Resolution website.
Cancellation
You can cancel or change any of your current orders up until the amendment cut-off point specified in your order confirmation. You can make changes to your basket by going to 'My account' and selecting 'Grocery orders', 'Cancel this order'. Or click on the link 'My orders' in the top right corner of the grocery site and select 'Cancel this order'. Alternatively, you can call our Customer Services team on 0800 323 4040 or 0330 123 4040 (local rate from mobiles). Please note that orders cannot be cancelled by email.
Payment
We accept the following payment methods: Visa, Mastercard, American Express, Maestro, Visa Debit, Tesco Bank credit and debit cards. We're unable to accept Maestro cards for Delivery Saver payments. We don't currently accept Visa Electron cards, Tesco Gift Cards or cash. If you do have an Electron card, please check with your issuing bank as they can upgrade your card to let you shop online with us. You can also pay using Clubcard Vouchers. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order.
For grocery home delivery and Click+Collect, in order to help us validate your payment card, a pre-authorisation for £0 is triggered automatically when you check out. Upon validation, checkout can continue. On the day of delivery, full authorisation takes place whereby the total amount is requested from your bank. Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. For grocery orders payment is taken at the point of dispatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
For F&F clothing orders the payment is taken at the point of the order being placed.
Product information
Wine
We work hard to make sure the ABV (alcohol by volume), vintage and award information is displayed online as accurately as possible. However, as we refresh stock constantly, changes can happen at any time, which may result in us supplying a different ABV and vintage.
General
These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Dietary and Lifestyle Search Facility
We offer a food preference search function to help customers with dietary or lifestyle needs to find relevant products on our Grocery website and app.
We engage registered nutritionists to review data on the food products we sell to ensure they accurately match your dietary profile. However, food products are frequently reformulated, ingredients may change and manufacturers' data may be incorrect or incomplete.
The search results displayed will contain products from both the Tesco Free From range as well as other products that have been identified as not containing a specified allergen as an ingredient.
Tesco Free From products are produced under controlled conditions to ensure their product claims are valid and not misleading, so they are suitable for specified dietary needs.
The other products have been collated by reviewing their ingredients list and any 'may contains labelling', so although they will not contain a specified allergen they may not have been produced under controlled conditions, so therefore we cannot guarantee they are suitable for a specific dietary need.
We recommend that you do not rely solely on this information and that you always double check product labels. The search function is designed to help you save time and identify potentially suitable food, but it should not be used as an alternative to medical advice and your own checks.
No gluten

Whoosh
Please read these terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you (“Whoosh Terms"). By using Whoosh you agree to these Whoosh Terms. Please note that our General Terms and Conditions also apply to your use of Whoosh.
Availability
Whoosh is only available in selected locations, and we only deliver goods to addresses close to the participating stores.
The Whoosh webpage and app section will show products that are available for delivery in Whoosh delivery areas when the Whoosh service is available. The Whoosh product range will differ to Tesco’s standard grocery home shopping range and the full range available in the store branch. Availability hours may vary and are subject to change and may differ from the availability hours for Tesco’s standard grocery home shopping.
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you.
To ensure that we can fulfil your order, there is a maximum weight and volume limit. Should your basket exceed these limits, you will be required to remove items until the basket is within the limits before you can complete the order.

Whoosh is available for non-commercial and domestic use only. We reserve the right to refuse orders from businesses, or orders that we consider are placed for commercial or other non-domestic purposes.
For apartment blocks, we’ll try to deliver to the front door of your flat. However, we may deliver to the property’s main entrance if the driver believes it’s unsafe or impractical to deliver to your front door. For business addresses, we’ll deliver to the ground floor communal area/entrance. For hospitals or other public addresses, it is at the riders discretion to deliver to the front door or not.
Minimum Basket Charge
There is a minimum basket value of £15. However, we’re able to deliver shopping that is less than this – but will charge an additional £2 minimum basket charge on top of the delivery fee.
If the value of the products in your basket when you confirm your order is less than £15, then we will add a £2 charge to your order. We will add the charge to your total at the checkout page, before you pay. If you go back and change your order, so that the value of your order is greater than £15, we will remove the charge.
You will earn Clubcard points on the £2 charge.
If we apply a charge to your shop, and we give you a refund for your entire shop, we will also refund the £2 charge. However, we will not refund the charge if only some of the items in your shop are refunded.
Delivery
All deliveries are subject to a delivery charge. Once you place your order, you agree to pay the delivery charge. The cost (if applicable) of any bags used to deliver your order will be included within the delivery charge.
Whoosh deliveries will be fulfilled by a third-party supplier (Delivery Partner) and will be made to the address specified by you when you place your order.
The Delivery Partner will deliver your order to the main entrance of the delivery address.
For deliveries to customers at a business address, the Delivery Partner can deliver to the ground floor communal entrance of your business, but unfortunately, the Delivery Partner is not able to come to your desk. If your business has a shared ground floor reception, this is where we'll deliver your shopping.
All goods must be received by an adult aged 18 years or over.
If your Whoosh order contains any age-restricted items (including but not limited to tobacco, alcohol, knives or razors) proof of age will be requested regardless of your age. The courier will then record your date of birth and deliver the goods. Please get one of the following valid forms of identification ready to prove you're over 18:
• A passport
• A photocard driving licence
• A proof of age card bearing the PASS hologram
• A Ministry of Defence Form 90 (Defence Identity Card)
If proof of age is not available, the goods will not be delivered to you. We reserve the right to retain the delivery charge and the cost of any perishable items. We'll refund you the price you paid for any non-perishable items.
If the Delivery Partner attempts to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, your order will be cancelled. We reserve the right to retain the delivery charge and the cost of any perishable items. We will refund you the price for non-perishable items automatically, you do not need to do anything. This should be with you in the next 3-5 working days and will be made to the card you paid with.
We aim to make delivery within 60 minutes of you checking out your order. However, whilst the Delivery Partner will make every effort to deliver all your goods in the agreed time, we will not be liable if the Delivery Partner fails to do so due to circumstances beyond our or the driver's control.
Delivery slots are subject to availability.
Proof of delivery is required for all orders - there are 2 methods that will be used depending on our Delivery Partners. If your order contains an age restricted product, you may be asked for a signature, or a photo will be taken of the Whoosh bag(s) on the doorstep. If the order does not contain an age restricted product only the photo will be required.
Prices and VAT
Please note that the prices on our Grocery website and app are guide prices only. Payment is taken at the time of checking out an order. If your final order is less than expected, or unavailable, we will refund you automatically. When your order is delivered, you may then return any item to a Tesco store and receive a full refund if you are unhappy with the price charged.
All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rate specified when you place your order.
Prices for goods on Whoosh may differ and be higher than the prices in our stores and higher than those prices for goods available for Tesco’s standard grocery home shopping.
Returns and Refunds
We'd like you to be happy with everything you purchase from Tesco. Unfortunately, your order or individual products cannot be returned to the driver at the point of delivery. If you have changed your mind about any of the products you have ordered, you can return it to your local store - please bring a copy of your delivery note. If you are unhappy with any of the products, please contact Tesco Customer Services.
Please see our Returns and Refunds Policy for details of how to obtain a replacement or refund. Our refund policy is in addition to and does not affect any of your legal rights. If you have any complaints about an online transaction, please get in touch at our Contact us page and we will work hard to find a solution.
If you would like to escalate your complaint, you can take the matter to Alternative Dispute Resolution (ADR). Although we do not participate in an ADR scheme, one such scheme is provided by Consumer Arbitration.

Changing your order
You cannot make changes to any of your current orders once your order has been placed.
Payment

The total amount is requested from your bank at the time of placing your order.
Please make sure that the expiry date of your payment card is after the expected delivery date of your order. In the event that the payment card has expired, we will be unable to take payment and fulfil your order.
You don't need to spend a certain amount to place an order. But if your basket is under £15, we'll charge you an additional £2 on top of our usual pick, pack and delivery charge. The delivery charge does not count towards the minimum spend.
Payment is taken at the time of checking out an order. If your final order is less than expected, or unavailable, we will refund you automatically, you do not need to do anything. This should be with you in the next 3-5 working days and will be made to the card you paid with.
You can find more information about why your order total was less than expected on the receipt email we sent you or by looking at your email receipt on our app or website.
This is because the price of individual items may be higher or lower than when ordered. Pre-packed, weighed items like meat, poultry and cheese may also vary slightly in price.
Tesco Delivery Saver
Whoosh orders are excluded from all Delivery Saver plans (Anytime Delivery Saver plan, Off Peak Delivery Saver plan and Click+Collect plan).
Coupons
In addition to the following, please also refer to your coupon as individual terms and conditions may apply. These terms and conditions are in addition to the Whoosh terms and conditions.
• Unless otherwise stated, coupons can only be redeemed online at tesco.com/whoosh and only one coupon starting GR or GC is valid per transaction after promotions are applied.
• Coupon is only valid on orders placed and delivered by the specified expiry date.
• Coupons have no cash redemption value, are not to be transferred, bought, sold or in any way traded or published, and are valid in the UK and IOM only.

• Excludes purchases at/on any lottery products, Tesco or branded gift cards, e-top up, opticians, phone store, savings stamps, postage stamps, prescription medicines, infant milk formulae, alcohol, Bags for Life, Delivery Saver subscriptions, delivery or collection charges, Tesco Bank, travel money and Clubcard Plus subscriptions. Other products may also be excluded at the discretion of Tesco.

General
These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

Where we need to make changes to these terms and conditions, we reserve the right to do so in any of the circumstances listed below, by uploading a suitably updated version of these terms and conditions to the Whoosh website or Tesco app:
• or legal, regulatory or security reasons;
• to implement reasonable technical adjustments and improvements; or
• to ensure the ongoing operability of the services.
In addition, we may make material changes to these terms and conditions, by posting an update on our website or app, or by other reasonable means, such as email.
Your continued use of the service will constitute your acceptance of any material change(s) that may have been made in accordance with the above arrangements.

Before entering a Tesco store operating the GetGo service (a "Tesco GetGo Store"), please carefully read these Tesco GetGo Customer Conditions and any other applicable rules, policies and terms which are posted in stores or on the Tesco website (collectively, the "Agreement"). By entering a Tesco GetGo Store, you agree to be bound by this Agreement. The Tesco GetGo Customer Conditions apply to all in-store transactions made in a Tesco GetGo Store.
When we use the term "basket" in these GetGo Customer Conditions, we're referring to the group of items selected by you (and those shopping with you in your group) for purchase, regardless of whether a physical basket or trolley is actually used.
Tesco GetGo Customer Conditions
1. TESCO STORE CONTRACT
By stocking our shelves, Tesco makes an offer for you to buy any of those items that are stocked and labelled in a Tesco GetGo Store. You accept this offer and purchase those items when you leave a Tesco GetGo Store with the items you have chosen for your basket. When leaving a Tesco GetGo Store with your basket items, if you're using the GetGo service, you agree that you will be charged for those items via the default payment option you provided to us when you signed up to the GetGo service or as subsequently updated by you.
Any refunds (if applicable) will be provided in accordance with our standard returns policy and refunds.
2. DATA PRIVACY

3. PRICING AND PAYMENT ISSUES
Tesco's GetGo service continues to evolve and improve. So, there may occasionally be minor issues with the pricing or payment mechanism when you leave a Tesco GetGo Store with your basket items. If there has been an error when calculating or taking payment, we'll either issue a refund to the payment method that you provided for your Tesco experience, or take further payment from it, if necessary. All prices are as advertised and provided in the relevant Tesco GetGo Store and are inclusive of VAT.
4. YOUR TESCO ACCOUNT
In order to use the GetGo service in a Tesco GetGo Store, each time you visit, Tesco will ask you to provide information on your Tesco app to confirm your identity before you access the store. You'll be required to be signed in to your Tesco account via the app and have a valid payment method associated with it. You agree that Tesco may charge any other valid payment method associated with your Tesco account, if there's a problem charging your selected payment method when you leave a Tesco GetGo Store with your basket items.
Using your account details and contact information, Tesco will send you an electronic receipt for your basket items and you'll be notified when the receipt is available. You consent to receive transaction receipts electronically.
All account details and payment information that you provide to Tesco are subject to Tesco's privacy notice, but you are responsible for maintaining the security and confidentiality of your Tesco account and password and preventing any unauthorised access to your account. To the extent permitted by applicable law, you agree to accept responsibility for all activities and transactions that occur associated with your Tesco account. You should take all necessary steps to protect the confidentiality, security and integrity of your account and password information. Please inform Tesco immediately if you suspect or have any reason to believe that your account has been used in an unauthorised manner, or your account and password information have become known to anyone else or otherwise compromised.
5. LIABILITY
Tesco and its affiliates will not be responsible for: (i) any losses not caused by Tesco's breach of these Tesco GetGo Customer Conditions; or (ii) any indirect or consequential losses that were not foreseeable to both you and us when any contract for the sale and purchase of goods from Tesco stores was entered into and performed. Nothing in this clause limits or excludes our responsibility for fraudulent representations made by us, or for death or personal injury caused by our negligence or wilful misconduct.
Tesco will try to make sure that transactions with you are error-free. As this Tesco GetGo service continues to evolve and improve, Tesco can't guarantee that no unintended mistakes or errors will occur, in which case Tesco will reasonably cooperate with you to make sure any issues are sorted out swiftly. During any required upgrades, maintenance, or repairs to in-store technology, your access to a Tesco GetGo Store may also be occasionally suspended or restricted.
6. RESTRICTED ITEMS
We operate a Think 25 policy for all age-restricted sales. You're only permitted to buy age-restricted items if a Tesco colleague verifies the sale in accordance with our age verification procedure, find out more in our 'Information about our stores' FAQ.
7. AMENDMENTS TO CUSTOMER CONDITIONS
Tesco reserves the right to make changes to Tesco's policies and terms and conditions, including these Tesco GetGo Customer Conditions, at any time. Changes will apply from the date of the change (and not to any previous transactions).
8. SEVERABILITY
If any of these Tesco GetGo Customer Conditions are deemed invalid, void or for any reason unenforceable, the relevant clause will be deemed severable and won't affect the validity and enforceability of any remaining clauses contained in these Tesco GetGo Customer Conditions.
9. WAIVER
If you breach these Tesco GetGo Customer Conditions and we take no immediate action, we will still be entitled to use any or all of our available rights and remedies in the future or in response to any other situation where you breach these Tesco GetGo Customer Conditions.
10. APPLICABLE LAW
These Tesco GetGo Customer Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live. If you'd like to bring a matter to our attention, please contact us.
11. CONTACT TESCO
For any help or support with your Tesco experience, please get in touch with any of our in-store colleagues or customer service team. This may include if any items you've bought are incomplete, damaged or defective, or you were charged for an item that wasn't selected and included by you in your basket.
These Tesco GetGo Customer Conditions are owned and maintained by Tesco Stores Limited.
Part B – Purchasing from Marketplace partners
When you shop on Tesco Marketplace (“Marketplace”) through the website or the app (the “Site”), these terms and conditions will apply.
Please read these terms carefully as they affect your rights and liabilities under the law and set out the terms under which Marketplace products are made available to you.
In addition to these terms, you should refer to the specific partner’s terms and conditions of sale on our Marketplace partners' contact details page (“Terms of Sale”), as when you purchase a product from a partner, both these terms and that partner’s Terms of Sale will apply (together the “Marketplace Product Terms”).
Our Tesco Product Terms (Part A – Purchasing from Tesco) do not apply when you purchase a product from a partner.
Marketplace
Tesco has an agreement with various sellers who are allowed to list and sell their products on Marketplace (“partner” or “partners”).
Tesco provides a service to partners by providing a platform for partners to sell their products to customers.
The product page will show which partner is making the sale and dispatch of the product.
The Customer (“You” or the “Customer”)
In order for you to shop on Marketplace, you must:
• use a payment method that is accepted on Marketplace;
• be authorised to use the relevant payment method (e.g. the payment method is in your name or you have permission to use it); and
• use Marketplace in a manner which complies with all applicable laws.
Please note, some of the products sold on Marketplace may not be suitable for anyone under 18 years of age. For example, you must be at least 18 years of age to purchase or receive alcohol.
The Partner(s)
When you purchase a product on Marketplace, you enter into a contract with the partner which is governed by the Marketplace Product Terms, and so the partner is responsible for:
• providing you with details about the product(s);
• providing you with the product(s); and
• dealing with any issues or complaints that you may have in relation to the product(s).
You enter into a contract with the partner when you place an order for its products on Marketplace and when such order has been accepted by the partner. Your order has been accepted by the partner once Tesco issues a despatch email to you.
These terms cover how you place an order on Marketplace and certain minimum commitments which the partner must adhere to (in respect of delivery and returns/refunds). The remainder of the terms and conditions of sale will be found in the Terms of Sale. If there is any inconsistency between these terms and the Terms of Sale, these terms will apply.
Partners may, from time-to-time, offer promotional or discount codes. Each promotional or discount code will have its own terms which will be explained by the partner at the time that it is issued to customers.
Unless Tesco is the seller of the product, Tesco is not a party to any contract entered into by you and the partner(s), Tesco is not an agent for the partners, and Tesco does not assume any responsibility arising out of, or in connection with, the sale or delivery of the products.
If you have a question or complaint about a product available for sale on Marketplace, you should contact the partner directly using the information from our Marketplace Partners' Contact Details page. However, if you are not satisfied with how a partner is dealing with your question or complaint, please contact Tesco using the information from the Customer Services section of these terms below.
Placing an order
In order to place an order on Marketplace, you should follow the same steps as you would to place an order with Tesco. Our shopping pages will guide you through the required steps to place an order. You will be required to add products to your basket(s) and then complete your order through the Tesco checkout process. Our order process allows you to check and amend any errors before submitting your order.
Please note that there will be one order for Marketplace and one order for Tesco products (if you are ordering Marketplace products and Tesco products at the same time). If you are purchasing from multiple partners and/or a partner via different delivery options your Marketplace order will be split between multiple baskets. You will be able to check out Marketplace and Tesco orders simultaneously.
Before you finalise your order, you will be given some delivery options (including estimated delivery times and dates) depending on the delivery options that the partner offers for its products and your delivery address.
On the order summary page, you will be able to see price information, delivery options and specific delivery details for products bought from each partner on a Marketplace order.
You will be charged separately for Marketplace and Tesco orders (if you are ordering Marketplace products and Tesco products at the same time). The payment for the order will be processed immediately by Tesco’s chosen third party payment provider(s). The payment provider(s) will send your funds to the partner (on behalf of the partner) but will not share your card details with Tesco or the partner.
Once payment has been made and you complete your order through the Tesco checkout process, you will receive an order confirmation from Tesco acknowledging receipt of your Marketplace order (and a separate order confirmation for your Tesco order if you bought Marketplace products and Tesco products at the same time).
The products are fulfilled and sold by the partner and all orders are subject to availability.
On the rare occasion a partner may need to refuse or cancel an order after you have received confirmation of your order, Tesco will inform you of this by email and will not process your order. If you have already paid for the product, you will be refunded the full amount including any delivery costs charged as soon as possible.
Prices and VAT
Please note that each product price on Marketplace is set by the partner who is selling the product. The price of the items do not include delivery charge(s).
All prices are expressed inclusive of any VAT payable, unless otherwise stated.
Tesco is not involved in the pricing of products on Marketplace and has no liability to you for any products which are incorrectly priced or described.
Where there is an offer on a product which refers to a ‘was’ price, that price may have been charged through the partner’s other retail channels rather than on Marketplace.
Payment
On the order summary page, you will be required to make payment separately for Marketplace and Tesco orders (if you are purchasing products from both at the same time). The correct billing amount in GBP will be displayed before you enter your payment details.
All transactions on Marketplace are paid in GBP and can be paid via Visa, Mastercard, Maestro, Visa Debit, Tesco Bank credit and debit cards (credit and debit card payments). Transactions on Marketplace cannot be paid via American Express.
Tesco gift cards, e-Coupons and vouchers cannot be used to purchase products on Marketplace.
Clubcard Points
If you use your Clubcard, you will earn Clubcard points on your Marketplace purchases and this will be at an equivalent rate and subject to the same terms and exclusions to that when you buy products from Tesco.
Tesco is entitled to remove Clubcard points earned on a Marketplace purchase which has been returned and/or refunded.
You will not be able to spend Clubcard points on Marketplace products.
Delivery
Where you purchase products from multiple partners and/or one partner using multiple delivery options, each delivery will be subject to separate charges (where applicable) and be delivered separately to you.
Please see our Marketplace FAQ page for the delivery options and the delivery charges for Marketplace orders.
On the order-summary page, the delivery charges (if applicable to the order) will be provided by the relevant partner(s) depending on the delivery options offered and chosen by you.
Delivery will be arranged by the partner and will be made to the address specified by you when you place your order in accordance with your contract with the partner.
Marketplace products can be delivered to England, Scotland, Wales and Northern Ireland and such other locations as indicated by the partner. Where a partner is unable to deliver to specific locations in England, Scotland, Wales and Northern Ireland it will detail those locations in its Terms of Sale.
Partners operate a "Think 25" policy when delivering age-restricted products, so if the person receiving the product(s) looks under 25, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the product(s) will not be delivered to you. Partners reserve the right to retain the delivery charge and the cost of any perishable items. Partners will refund the price you paid for any non-perishable items where they have been unable to deliver the product(s) to you.
If you experience issues or delays with delivery or if you require further information about delivery, you should contact the partner directly using the information from our Marketplace Partners' Contact Details page. Tesco shall bear no liability or responsibility for any delivery issues encountered by you. However, if you are not satisfied with how a partner is dealing with your complaint, please contact Tesco using the information from the Customer Services section of these terms below.
Returns and Refunds
You will be able to action a return or refund via Marketplace on the “My Orders” section of your account which contains the order number, the products purchased and the number of days you have left to return the specific product(s).
To process a return or refund, you will be required to click onto the relevant item(s), choose the applicable reason for return (via the drop-down box) and provide further details as necessary to return the products. Once this has been completed, the partner will be notified of the request for return or refund and will be in touch with details about your return in due course.
You will be entitled to a full refund from the partner(s) on Marketplace for up to 30 days if you change your mind or your product(s) are faulty. Please see our Marketplace FAQ page for full details of the return and refund policy for Marketplace. This policy is in addition to and does not affect any of your legal rights.
In addition, a partner may offer additional return, exchange and refund options (above those set on Marketplace or required by law). Please refer to the partner’s Terms of Sale to see further details on the partner’s returns and exchange policy.
Please note, a partner may refuse to cancel an order or accept an exchange or return if an item has been used, opened or unsealed, or has been made according to your precise measurements (such as, made-to-measure) or has been customised or modified at your request. Partners may be unable to accept returns without original packaging or labels. If products are sealed for health protection or hygiene purposes then a partner will not be able to accept a return once the product has been unsealed.
Returns and refunds shall be solely issued and dealt with by the partners. Tesco shall have no responsibility or liability for any returns and refunds issued or processed by a partner.
Please do not send returns of Marketplace products to Tesco, or any of Tesco’s supermarkets or affiliated stores as your return will not be accepted. Marketplace will not be able to recover any items which are incorrectly sent to any Tesco stores.
Cancellation
Before your order has been processed for delivery, you can cancel or change any of your current Marketplace orders on the “My Orders” section of your account.
After your order has been processed for delivery, you cannot cancel or change any of your Marketplace orders and the partner(s) will deliver the Marketplace product(s) to you. You can still return Marketplace products if you’ve changed your mind (see Returns and Refunds above for how to do this).
You can also cancel your contract with the partner (if you’ve cancelled your order before or after your order has been processed for delivery) by completing and sending us the model cancellation form provided at the end of these terms.
Once you have cancelled your order, you will receive an email confirming your cancellation.
General
These terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
If any of these terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms which will continue to be valid and enforceable to the fullest extent permitted by law.
Our rights to make changes
Where we need to make changes to these terms, we reserve the right to do so in any of the circumstances listed below, by uploading a suitably updated version of these terms to the site:
• for legal, regulatory or security reasons;
• to implement reasonable technical adjustments and improvements; or.
• to ensure the ongoing operability of the services.
In addition, we may make material changes to these terms, by posting an update on the site, or by other reasonable means, such as email.
Your continued use of Marketplace will constitute your acceptance of any material change(s) that may have been made in accordance with the above arrangements.

Please note that it is the responsibility of the partners to supply you with products that meet your consumer rights and comply with any contract formed between you and the partner.
If you have a complaint about a product or a partner, please direct such compliant to the relevant partner. However, if you are not satisfied with how a partner is dealing with your complaint or dispute, please get in touch and we will do our best to help.
If you are still not happy, you can take the matter to Alternative Dispute Resolution (ADR). Although we do not participate in an ADR scheme, one such scheme is provided by Consumer Arbitration. More information on ADR can be found on the Trading Standards website.
