Privacy and cookies policy

Overview

At Tesco, we work hard to serve our customers, communities and planet a little better every day.  Looking after the data you share with us is an important part of this. We want you to be confident that your data is safe and secure with us, and that you understand how we use it to offer you a better and more relevant shopping experience and to run our business.

This policy is for Tesco Stores Limited. It explains what personal data we collect about you, how and why we use it, who we share it with, and the choices and rights you have.

If you use a Clubcard for 16-17s, please see the section "Clubcard for 16-17s" below for more information about how we use your personal data.

What personal data does Tesco use about me?

Tesco collects and creates different types of data, as explained below.

A. Identity and contact data

We collect information that helps us identify who you are and how we can contact you. This includes your name, title, Clubcard number, address, email, telephone number, and social media handle (where relevant).

We may also collect identity verification documents from you, like a copy of your ID or confirmation of your address for more sensitive interactions with you, such as if you raise a data rights request with us.

B. Financial and transactional data

We collect information about the payments you make to us, as well as information about your purchase of a product or service from us. This includes bank or payment account details, card details and when, where, what and how you purchased a product or service. It'll also include where we sent that product or service and any Clubcard points or other benefits collected as part of the transaction.

We maintain information about your Clubcard points, including to update your Clubcard points balance when you exchange your Clubcard vouchers with a Reward Partner.

Colleague Clubcard holders

If you use a type of Colleague Clubcard (including if you’re a second cardholder on a Colleague Clubcard, a next of kin recipient of a Colleague Clubcard, or if you have a Colleague Clubcard for Life), this notice applies to how we use your personal data as a customer too. From time to time, we may use your shopping data to create aggregated insights that help us to manage and improve our colleague benefits. For example, these insights could help us to understand if, overall, extending an exclusive colleague promotion event to other Colleague Clubcard holders helped to improve colleague satisfaction results.

C. User and interaction data

We collect information about how you use our stores, products and services. This includes information about what you click on and interact with on our sites and app, or products in-store, such as the order and time you scan products when using our Scan as you Shop service.

This also includes any survey responses or other feedback you provide about your shopping experience.

We collect data that is captured by CCTV and other camera technologies in-store, such as queue monitoring, scan assistance technology that tells you if an item hasn’t been scanned properly at self-checkout, and number plate recognition in our car parks and some petrol forecourts.

Scan-free checkouts

In some stores, we operate a scan-free checkout system, which recognises items you’ve picked from the shelf and automatically completes your basket at the till.

In these stores, we use a camera and measurement technology that records you as you move around the store interacting with our products. The images from these cameras are analysed so we know which products you’ve picked up and taken to the scan-free checkout with you. This allows us to automatically add them to your basket at the till, without the need for you to scan each item individually. These images (and any information that comes from analysing them) are usually deleted within 5 days.

Personal data collected by the scan-free checkout system is used for providing this service, and for the purpose of troubleshooting and improving the accuracy of the system.

The scan-free checkout system is provided by our third-party partner. However, we don't share any additional personal data about you with them, so they won't know who you are.

D. Marketing data

We collect information about your marketing preferences and your interaction with online marketing. For example, we can see when you open marketing emails from Tesco (you can opt out of marketing at any time by updating your marketing preferences).

We also measure whether you interact with adverts from Tesco while browsing the web. This enables us to judge how effective these ads are, when we compare your online interactions with what you've purchased.

E. Location data

In some cases, our app might ask for your location information to better serve you information about your local store. If we're collecting this data, we'll make you aware of this at the time and let you choose.

F. Technical device data

This is information about the device you use to access our sites and app. This could be information that identifies your device, its operating system, IP address, your sign-in data, browser and plug-ins, location, where you came to our site from and where you go when you leave, as well as how often you visit. If you use our in-store Wi-Fi, we'll collect information about where and when you accessed our network. This is done via the use of cookies, which is explained further in the cookies section below.

G. Special category data

This is information that the law says is more sensitive and needs more protection. Sometimes it's referred to as "sensitive personal data". For Tesco Stores Limited, this is principally health information.

If we collect this data in our interactions with you, we'll clearly explain what we're doing and why.

H. Data collected from third parties

We may also use personal data from other sources, including specialist companies (such as Sagacity), media partners, retail partners, selected brands and public registers (such as the electoral register).

When we work with Sagacity to provide us with personal data about you, they'll have told you about this data sharing at the time it was collected.  Personal data we receive from Sagacity includes estimated age and affluence (within ranges), presence of children (plus estimated age range) and address information (e.g. "gone away" flags or redirection information). We use this data to better understand our customers and to make sure we have up-to-date details about you. We don't give personal data we’ve collected or created from you back to Sagacity.

I. Aggregated and pseudonymised data

We try and remove personal data we don't need. If we remove enough personal data, it becomes anonymous. This means that you can't be identified.

We create pseudonymised personal data by removing directly identifiable information about you (like your name or email address) and replacing it with other information, such as an ID number or reference number. This is a technique we use to protect and minimise data. We normally pseudonymise data when we combine large amounts of data, such as our Clubcard customers, to provide aggregated insight and analytics that doesn’t relate to a single person, like the nation’s favourite Meal Deal combo.

We've considered the reasons for collecting and/or creating this data. Here's a summary of our different purposes for using personal data about you, together with details of the legal basis in each situation.

To make our services available to you

We need to process your personal data so that we can manage your customer accounts (including your Clubcard account), provide you with the goods and services you want to buy, and help you with any orders and refunds you may ask for.

Legal basis

• Contractual necessity - at the time we collect it (purchase data, contact details, delivery/collection details). We won't be able to provide you with your products or services if you don't provide us with this data.

• Legitimate interests - following fulfilment of your order

To manage and improve our day-to-day operations

We use your personal data to carry out market research and internal research and development. This helps us to improve our product range, services, stores, systems (including security), know-how and communications.

Legal basis

• Legitimate interests

To personalise your Tesco experience

1. Manage and improve your experience on our websites and mobile app.
We use cookies and similar technologies on our websites and mobile app to manage and improve your experience.

Some cookies are necessary so you shouldn't disable these if you want to be able to use all the features of our websites and mobile app.  For more information about cookies and how you can disable them, see our cookie consent manager and the cookies section below.

2. Better understand you as a customer and personalise your experience.

We use data about your general shopping habits and those of similar households – such as browsing behaviour on our websites and mobile app, in-store and online purchases including Clubcard transactions – to group customers into different behavioural segments. These segments help us anticipate your shopping needs or product preferences and inform, for example, how likely you are to do a top-up shop, hunt for promotions or shop online. We use these segments together with other information about you, such as your local store and data collected from third parties (see above for further details) to personalise our offers and services for you, including in our marketing communications.

3. Provide you with relevant and tailored marketing communications.

We may send you marketing messages by email, text, push notification and post – and display online advertising to you – in line with the marketing preferences you’ve chosen. These are to tell you about our products and services, and those of the Tesco Group, our suppliers, retail partners and selected brands.

Online advertising may be displayed on the Tesco app, websites across the Tesco Group, non-Tesco websites, other media platforms (including connected TV platforms such as Sky, Virgin Media, ITVX and Channel 4 and social media such as Meta, Snapchat and TikTok), digital audio services and other digital advertising environments. Advertising may also be displayed on digital screens and Scan as you Shop handsets in-store, and on out-of-home digital screens.

We may also measure the effectiveness of this advertising. To do this, we use data about your in-store and online purchases – for example, if you bought a particular product that was featured in an advert. However, we limit this to what is necessary, and it is obscured or anonymised where possible to protect your identity.

We use this data to make sure that we and our partners provide you with marketing communications, including online advertising, that are relevant to your interests. To achieve this, we measure your responses to marketing communications relating to the products and services being offered.

Legal basis

• Legitimate interests
• Consent (e.g. for device information, cookies and similar technologies)

To contact and interact with you

1. Customer services

We provide essential service information and/or reply to your customer service queries by phone, email or post, or by responding to social media posts that you’ve directed at us. We do this to serve you better as a customer.

2. Promotions and competitions

We need to process your personal data, so that we can manage the promotions and competitions you choose to enter.

3. Customer surveys, reviews and market research

We may invite you to take part in and manage customer surveys, reviews and other market research activities carried out by the Tesco Group and by other organisations on our behalf. We carry out market research to improve our services, as explained above .

If this research is through our Tesco Home Panels service, we’ll give you additional information about how we use your data when you sign up for this service. We have a separate privacy policy for Tesco Home Panels which explains how data is used when you become a panellist.

Legal basis

• Legitimate interests

This might be needed if you have an accident or there's an incident at our stores, for example. This could include medical reports.

Legal basis

• Legitimate interests

• Bringing or defending legal claims

To protect our stores, customers and colleagues

We monitor how our services are used to detect and prevent fraud, other crimes and the misuse of services. This helps us to make sure that you can safely use our services.

If you park in our car parks, we may use Automatic Number Plate Recognition Technologies (ANPR) to identify if your vehicle has complied with our parking rules.  In our petrol forecourts, we may use ANPR to identify a vehicle that has no means of payment and/or leaves the premises without paying for fuel. Where there’s a security or claim incident involving a vehicle, we may use ANPR to assist in our investigation into those incidents.

We use body-worn cameras to protect staff and customers, and record footage in the same way as we do with other forms of CCTV.

We do all of this to protect our business, the local community, customers and colleagues.

Non-live (retrospective) facial recognition

If you engage in suspected criminal activity in store, then CCTV footage of the incident may be captured and logged.  After the event, we may review CCTV footage using non-live (retrospective) facial recognition technology, to help us understand whether you have engaged in other suspected criminal activity in Tesco stores. Identifying repeat offenders helps us to keep our stores and colleagues safe through better quality crime reporting.

We’re trialling this technology in selected stores, where signage will be displayed.

We’re using non-live (retrospective) facial recognition technology.  This means that we don’t scan anyone’s face in real time. Instead:

• After an incident has taken place, specifically trained Tesco colleagues manually review CCTV footage and extract facial image(s) of the suspect.

• They send these facial images to our third-party crime intelligence partner, Auror Europe Limited (Auror).  Under Tesco’s instruction, Auror uses AI technology to suggest facial image matches to other incidents in Tesco trial stores.  It does this by creating an encrypted biometric template of the suspect’s face and comparing it against a database of templates from other incidents in Tesco trial stores over the past 2 years.

• If the technology suggests a likely match (e.g. that this person was also involved in several previous incidents), this is manually verified by a specifically trained Tesco colleague.

• The new template is also added to the database described above.

• Tesco Stores Limited and Auror act as joint controllers for this processing.

Several privacy controls are in place for the use of non-live (retrospective) facial recognition technology.  For example:

• We only use non-live (retrospective) facial recognition technology to investigate theft over a set amount, burglary, robbery and physical assault, and only in selected trial stores.

• We use facial images of the suspect only.  Anyone else is manually cropped out or redacted from the CCTV footage.

• We only use facial images that meet our strict quality standards.

• We don’t use this technology if a suspect looks under 18.

• Human input is always needed to confirm a match.

The CCTV image(s) and template(s) from an incident are deleted from the database described above within 2 years.  Where relevant, data will be kept in line with our data retention policy for investigations.

This information may be shared with the police, other law enforcement authorities and other retailers to assist our investigation into an incident.

Legal basis

• Legitimate interests

• Exercising our legal rights

• Substantial public interest – to prevent or detect unlawful acts

To deliver Tesco Pharmacy services

We need to process your personal data, including your medical information, to make sure we provide you with the highest standard of care and/or as required by the NHS. Your prescriptions information won’t be used for any other purpose than to enable your care.

Information about non-prescription medicine sales (e.g. paracetamol) and pharmacy services (e.g. weight loss management, flu and travel vaccinations) will be used to measure and plan these healthcare services.  We also create anonymous, aggregated statistics to help us understand how weight loss management changes shopping habits.

Health data is special category data, as explained elsewhere in this notice.

You may choose to opt out of the NHS using your data for planning and research purposes by:

• visiting the www.nhs.uk/your-nhs-data-matters website portal

• using the NHS App

• calling the NHS Digital contact centre on 0300 303 5678

Legal basis

• Consent (where we need this from you)

• There are legal and regulatory obligations to the NHS

• It is necessary for the purposes of providing medical care or treatment

• It is necessary for statistical purposes

When we rely on 'legitimate interests' as a lawful basis, these are to:

• meet our customers' needs, including delivering our products and services and providing an improved experience online and in-store

• promote and market our products and services, and those of the Tesco Group, our retail partners, selected brands, media partners and service providers

• service your account (such as your Clubcard account), manage complaints and resolve any disputes

• understand our customers including their patterns and behaviours, as well as their likes and dislikes

• protect and support our business, colleagues, customers and shareholders

• prevent and detect anti-social behaviour, fraud and other crime

• test and develop new products and services, and improve existing ones

We've assessed these against the fundamental rights and freedoms provided to you under the law and balanced them up against the benefit both you and Tesco might receive from this data being used.

Do you share my data?

We may share personal data with other organisations (including Tesco Group and Tesco Bank as listed below) in the following circumstances:

• to deliver the products and services we have offered to you

• with our retail partners, selected brands, media partners and service providers (as explained below)

• to establish, exercise or defend our legal rights or where we need to by law (this includes for the purposes of preventing fraud)

• where we restructure, sell, or transfer our business (or a part of it). For example, in connection with a takeover or merger.

Service providers

These are organisations that help us to deliver and improve the services we offer to you. For example:

• technology and data services (such as storing, combining and analysing data, and processing payments)

• fulfilment of orders

• legal or other professional services.

We only share personal data where it’s necessary for these organisations to provide their services. We may also combine service providers’ data with data held by Tesco to understand your purchases and interactions with us better.

Retail partners

We work with several retail partners who:

• sell products and services via Tesco (e.g. brands whose items you buy in store or on Tesco.com, including Marketplace)

• you can earn Clubcard points with (Points Partners)

• you can spend Clubcard points with (Reward Partners).

We share personal data that enables our retail partners to provide services you've requested.  We also share personal data with retail partners for marketing, analytics and advertising purposes, as explained elsewhere in this privacy notice.

Selected brands

We also work with selected other brands and organisations to tell you about their products and services if we think you’ll like them. For example, if you have a holiday on the horizon, you might see inspiration from travel brands or if you’re planning a night in, you could see new show launches from your favourite streaming service. You might spot this advertising in places like your online account and where you confirm your orders, on social media and in our emails.

We use several measures to only share masked (or pseudonymised) personal data as necessary for online advertising, which apply to our selected brands too. Our measures include:

• matching our customers with the customers of selected brands where possible in a way so that neither Tesco nor the advertiser receive or see the other’s customer’s data,

• obscuring information that can directly identify you, like your name, and replacing that with a code, and

• providing only aggregated information to advertisers to help them understand how well a particular advertising campaign performed.

You can choose to opt out of adverts for other brands at any time through your marketing preferences pages in ‘My account’– just adjust your settings for ‘selected brands’.

We work with some selected brands to help us better understand our shared customer base, their broad behavioural patterns, and joint commercial opportunities.  When we do this, we obscure any information that can directly identify you, like your name, by replacing it with a code.  The insights and analytics we create are aggregated, which means that you can’t be identified from the outputs.

Media partners

We work with certain media partners in connection with online and other digital media services. They place relevant advertising for us, our retail partners and selected brands online and through other digital media services. For example, you may see an advert for our products and services when you use a particular platform or stream your favourite TV show.   These may include media platforms that display advertising (such as Meta, Google, Pinterest and TikTok), as well as partners that support audience selection, measurement and campaign services (such as dunnhumby and LiveRamp).

Some examples of the ways we work with our media partners are listed below:

Targeted advertising on TV and streaming platforms

If you're a Tesco customer and you also watch or stream TV on platforms such as Sky, Virgin Media, ITVX or Channel 4, you may see targeted TV adverts on those platforms, based on your general shopping habits (and those of similar households). For example, you may be in a group of households which is shown an advertisement for coffee, having previously bought coffee at Tesco with your Clubcard.

We don't share any information which directly identifies you (such your name, Clubcard number or address) nor do we share your purchases.

You can opt out of each platform’s targeted TV advertising at any time:
1. via your account settings within the relevant platform, or by contacting the platform directly (see their websites for further details), or
2. by opting out of all direct marketing from Tesco via your tesco.com account.

Further information about targeted advertising on TV and streaming platforms can be found in each platform’s privacy policy.

Advertising to custom audiences

We work with our retail partners and selected brands to show relevant advertising to groups of customers on platforms such as Pinterest, Meta and Google.

To do this, we use information about your general shopping habits to create large groups of customers called ‘custom audiences’, who may be interested in seeing advertisements from our retail partners and selected brands. If you are included within a custom audience for a particular campaign, we may share some basic data about you (and other customers in that audience) with the platform so that the platform can show relevant adverts to you on its services.

The data we share for these purposes is obscured to help protect your identity and is deleted promptly after use.

You can opt out of us using your data for custom audience advertising by updating your marketing preferences via your tesco.com account. You may also be able to manage certain personalised advertising preferences directly through the settings provided by the relevant advertising platforms.

Tesco Bank

Tesco Bank (owned by Barclays Bank) works with us to serve Tesco's shoppers by bringing them banking products. They use information we hold at Tesco to prepopulate application forms to make the process easier for you. You'll always have the chance to update your information.

We make Clubcard data (including your shopping habits and the types of purchases you or your household make), and information about your online behaviour we've collected through cookies, available to Tesco Bank. This helps them to improve their service, understand the relationship of their customers across the Tesco Group, and make their marketing communications more relevant to you.

Tesco Bank uses Clubcard data (including shopping habits and the types of purchases your or your household make) to try to bring you better terms, deals, offers or support than you'd get if they didn't use the data. They do this by creating customer segments and scores based on factors such as how likely they think you are to pay back money they lend you, how often you use other Tesco products and services, and how you prefer to shop.

They then use these scores as one of the factors in their automated decision-making process. They also consider whether or not you're a Clubcard customer or have an existing Tesco Bank product.

Tesco Bank only uses Clubcard data to give better prices or offers and never to increase prices or decline an application.

We also receive personal data from Tesco Bank when we deliver shared services, like customer service. We use data provided to us by Tesco Bank, for example, information about the Tesco Bank products you hold to award Clubcard points collected as part of a Tesco Bank product, or to improve our service and make our marketing communications more relevant to you. When Tesco Bank share data with us, they only share the minimum amount needed.

You can find more information about the way in which Tesco Bank use your data in their privacy and cookies policy.

What about within the Tesco Group?

Tesco Insurance

Tesco Insurance (i.e. Tesco Personal Finance Limited and Tesco Underwriting Limited) forms part of our Tesco Group. They help us to serve our customers by bringing them insurance and money services products. They use information we hold at Tesco to prepopulate application forms to make the process easier for you. You'll always have the chance to update your information.

We make Clubcard data (including your shopping habits and the types of purchases you or your household make), and information about your online behaviour we've collected through cookies, available to them. This helps them to improve their service, understand the relationship of their customers across the Tesco Group, and make their marketing communications more relevant to you.

If you use a price comparison website, Tesco Insurance may use your Clubcard data to work out if they can offer you a better price.

They use Clubcard data to try to bring you better terms, deals, offers or support than you'd get if they didn't use the data. They do this by looking at the data using algorithms and computer programs to create customer segments and scores. This includes how likely they think you are to pay back money they lend you, how often you use other Tesco products and services, and how you prefer to shop. This helps them to create a number of scores, which they can then use as one of the factors in their automated decision-making process. They also take into account whether or not you're a Clubcard customer or have an existing Tesco Insurance product.

Clubcard data allows Tesco Insurance to give Tesco customers better prices on insurance products. Discounts and offers will vary from customer to customer, but all Clubcard customers will receive a discount within a range.

Tesco Insurance only uses Clubcard data to give better prices or offers and never to increase insurance prices or decline an application. They use Clubcard data when you apply directly to them or when you visit a price comparison website that lists Tesco Insurance products.

Tesco Insurance uses data that you provide, such as your name and address, to find any Clubcards that are linked to your surname and address. That might include your Clubcard or that of a family member living in the same house as you. When they do this, they aim to use the Clubcard with the highest level of household spend. This helps them apply suitable terms, deals or offers for that household.

We may also use data provided to us by Tesco Insurance, for example, information about their products you hold, to improve our service and make our marketing communications more relevant to you. When we share data across the Group, we only share the minimum amount needed.

You can find more information about the way in which Tesco Insurance and uses your data in their privacy and cookies policy and in the Tesco e-Gift card privacy policy.

Tesco Mobile

We make Clubcard information available to Tesco Mobile. This includes information about purchases when you use your Clubcard, and information about your online behaviour we've collected through cookies. This helps them to improve their service and make their marketing communications more relevant to you.

You can find more information about the way in which Tesco Mobile use your data in their privacy and cookies policy.

dunnhumby

dunnhumby, part of the Tesco Group, is also one of our main service providers and supports us in delivering analytics, insight and media services. dunnhumby helps us to:

• analyse our customer data to improve our understanding of customers and help personalise your customer experience;

• help us and our retail partners and selected brands to understand sales trends and identify groups of customers who may be interested in particular products, services and offers related to those products.  See ‘retail partners’ and ‘selected brands’ above for further details; and

• support the delivery and measurement of relevant advertising and retail media campaigns for retail partners and selected brands.

Find out more about what dunnhumby do.

Booker

Booker, part of the Tesco Group, provides wholesale goods. Find out more  about Booker.

One Stop

One Stop is part of the Tesco Group, and is a convenience franchise operator and retailer. From time to time, we may share your information with One Stop so they can tell you about One Stop stores in your area.

You can find more information about the way in which One Stop use your data in their  privacy and cookies policy.

How does Tesco look after my data?

We know how important it is to protect and manage your personal data. This section sets out some of the measures we have in place.

• We make sure staff are trained and rules are in place to make sure that data is used properly.

• We have physical protections and digital/electronic systems in place to keep what we hold secure.

• When data is moved or transferred, we make sure it's encrypted (scrambled).

• We use computer safeguards such as firewalls and data encryption to keep this data safe when it's not being moved.

• We only allow access to colleagues and trusted partners.

• We regularly watch our systems for possible weaknesses and attacks, and we carry out tests (penetration testing) to see what can be improved.

• We'll ask for proof of identity before we share your personal data with you.

• We'll reveal only the last four digits of your payment card number when confirming an order.

Does Tesco transfer my data outside of the UK?

Your personal data may be transferred outside the UK. It may also be processed by companies outside the UK who work for us (or for one of our service providers). When we do this, your personal data will be subject to appropriate protections. If we do transfer personal data to outside of the UK, it'll be protected in the same way as if it was being used in the UK. To do this, we use one of the following safeguards:

• We transfer to a non-UK country whose privacy laws ensure an appropriate level of protection for personal data.

• We put in place a contract with a third party that means they must protect personal data to the same standards as the UK.

• We transfer personal data to organisations that are part of specific agreements on cross-border data transfers with the UK.

Does Tesco keep my data forever?

We won't keep your personal data longer than we need to. In most circumstances, this means we won't keep your personal data for more than 7 years after the end of your relationship with us. For certain data sets, we have the following specific retention periods:

• Information about purchases and the payment information relating to those purchases might be kept for up to 7 years after the transaction to allow us to investigate fraud and handle legal claims.

• Customer complaints and feedback will be deleted 4 years after the date of the last communication.

• Information you submit when participating in research panels/market surveys will be deleted 3 years after its creation.

• CCTV data will be kept no longer than 31 days after its creation.

• Health and safety records (for example, incident reports) will be deleted 7 years after their creation.

• Where your personal data is needed because of a serious dispute (such as litigation) or investigation, your personal data will be deleted 7 years after the matter is closed.

Clubcard for 16-17s

This section applies if you sign up for, or use, a Clubcard for 16-17s.

What we collect and why

As part of the sign-up process, we ask you to confirm your date of birth. We use this to:

• check you are eligible for a Clubcard for 16-17s; and

• recognise when you turn 18 so we can invite you to a standard Clubcard account.

We also collect information described in the section “What personal data does Tesco use about me?” above.

How we use your data

If you have a Clubcard for 16-17s, we apply additional protections that are appropriate for your age. This means we limit some features and uses of your data that are not essential to provide the service. For example, we limit or switch off:

• marketing communications and online advertising;

• access to some online shopping journeys or optional Clubcard features; and

• some types of data sharing.

What are my data rights and how do I request them?

Access

You have the right to see the personal data we hold about you. This is called a subject access request or SAR.

If you'd like a copy of the personal data we hold about you, please email us at subjectaccess.request@tesco.com.

Objection to our use of your data

You can object at any time to us using your data where we rely on legitimate interests.

We'll consider your objection to our use of your personal data. If, on balance, your rights outweigh our interests in using your personal data, then you can ask us to either restrict our use of it or delete it. In almost all cases relating to marketing, we'll stop using that data at your request.
