Books Warehouse Product Terms & Conditions

Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you ("Product Terms").

  1. Prices

    The prices payable for the books that you order are clearly set out in the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed in the 'Help' section of the web site. Where books are ordered pre-publication, an estimated retail price will be given, in which case the price charged may be different, as the order may have been placed as much as three months prior to publication.

  2. Availability

    If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible.

  3. Acceptance

    There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods.

  4. Delivery

    Delivery will be made to the address specified by you on the completed order form. Please note that we can only deliver products within England, Scotland, Wales and Northern Ireland.

    We will do our best to secure delivery within 30 days of the date of your order (with the exception of books that have not been published yet) but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.

    Each book that you order will have an "availability date". This will be one of the following:

    • Available immediately - dispatched within 24 hours of the order being received
    • Temporarily out of stock - normally dispatched within 5 days of the order being received
    • Special order - normally dispatched within 10 days of the order being received
    • Not yet published - item will be dispatched as soon as possible after publication.

    If you order books with different availability dates, you can choose to have all the books held until the last book is delivered. If you do not choose this option, each book will be delivered separately, and you will be charged a delivery charge each time.

    If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible.

  5. Cancellation

    You have the right to cancel your order up to 14 working days after the day following the delivery of the goods by calling our Customer services dept on 08457 22 55 33*. Alternatively in the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods to us and we will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given.

    If you do not return the goods within 21 days of your cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the web site. This does not affect your statutory rights.

    Cancellation of books in your order. In the unlikely event that we are unable to obtain a delivery date from the publisher within 30 days of you placing the order we will cancel the book from your order. This does not apply to pre-release books.

  6. Returns

    We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.

    If you are unhappy with one or more books, simply return them in the original packaging within 14 days of dispatch and we will give you a refund on those items or replace the item. Any returned items must be in re-saleable condition. The dispatch note must be included in the package and the reason code for return entered in the R column on the right hand side of the dispatch note. (The reason codes are included on the dispatch note). If you would like a replacement book, then please also enter an X in the right-hand column.

    Books must be returned via the Royal Mail to, PO Box 106, Eastbourne, BN23 6WZ.

    Once returned items reach our warehouse, the refund or replacement will be actioned and you will be sent an email to confirm this. Please note that, in the event of a refund, Clubcard points received for the purchase of the refunded goods will be removed from your Clubcard account.

    Please note that items bought at the Books Warehouse cannot be returned to a Tesco store.

  7. Payment

    You can pay by any American Express, Mastercard or Visa credit card, Maestro or Delta debit card. We do not currently accept Visa Electron cards.Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will not be charged for items until they are dispatched.

    Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

    We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

    Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.

  8. General

    These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

    If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
