These Terms and Conditions govern your use of the tescohomephone.com website (Tesco Home Phone Site) and your relationship with Tesco Stores Limited trading as Tesco Telecoms (Tesco, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree with these Terms and Conditions, please do not register for or use the Tesco Home Phone Site.

The prices payable for Tesco Home Phone are clearly set out on the Tesco Home Phone Site.
Every effort is made to ensure that prices shown on the Tesco Home Phone Site are correct. If, by mistake, we have under priced a service, we will not be liable to provide that service to you at the stated price, provided that we notify you before we start providing the service to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the service at that price.
All prices are expressed inclusive of any VAT payable unless otherwise stated.

We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the online store. Any changes will be notified to you via a suitable announcement on the Tesco Home Phone Site. The changes will apply to the use of the Tesco Home Phone Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Tesco Home Phone Site. If you continue to use the Tesco Home Phone Site after the date on which the changes come into effect, your use of the Tesco Home Phone Site indicates your agreement to be bound by the new Terms and Conditions.
This paragraph on Clubcard is in addition to the Terms and Conditions of Tesco Clubcard.
To be awarded Clubcard points applicable to orders on the Tesco Home Phone Site you need to have a valid Tesco Clubcard or a Tesco e-Clubcard number that you must enter when requested on the Tesco Home Phone Site.
You will be awarded one point per £1 spent and the points will be added to your Clubcard in accordance with the Terms and Conditions of Tesco Clubcard.
Clubcard points received for the purchase of a service which is then cancelled may be removed from your Clubcard account.
The following items cannot be redeemed against purchases on the Tesco Home Phone Site:
paper Clubcard vouchers, electronic Clubcard eVouchers (which are issued for use on Tesco.com);
bonus coupons (which may be received with the quarterly Clubcard mailing, by email, awarded online or handed out in a Tesco retail store); and
product or discount coupons issued by manufacturers or promoters.
Tesco Telecoms may issue its own eCoupons directly or via Tesco channels or third parties.
This section sets out the terms and conditions for Tesco Telecoms eCoupons. Tesco Telecoms eCoupons are redeemable at the checkout page when making a purchase from the Tesco Telecoms Site. eCoupons can only be used on the Tesco Telecoms Site and are not redeemable on Tesco.com, through Tesco Stores Limited or Tesco Personal Finance.
We are entitled to cancel and reissue any eCoupons for any reason. We are entitled to suspend or change any aspects of the operation of eCoupons at any time.
Using Coupons
An eCoupon can only be used either as part payment for the service(s) stated on the eCoupon or in conjunction with the minimum spend threshold stated on the coupon in a single transaction.
If we reasonably believe that there is a breach of security or fraudulent use of eCoupons, we may reject any eCoupon.
You cannot sell an eCoupon. Once you have used an eCoupon once, you cannot use it again.
eCoupons may require a valid associated Clubcard number or email address to be given.
Restrictions on using eCoupons
Unless we tell you otherwise on the eCoupon, eCoupons cannot be used in conjunction with other offers.
eCoupons cannot be exchanged for cash or gift vouchers.
Refunds for services purchased under a promotional offer will be based on the terms of the promotional price paid. Your statutory rights are not affected.
The services provided by the Tesco Home Phone Site do not include the provision of computer or other necessary equipment to access the Tesco Home Phone Site. To use the Tesco Home Phone Site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.
The content of the Tesco Home Phone Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Tesco Home Phone Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non?commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Tesco Home Phone Site without written permission from Tesco Telecoms.
No licence is granted to you in these Terms and Conditions to use any trade mark of Tesco or its affiliated companies including, without limitation, the trade marks TESCO, Tesco Telecoms and TESCO CLUBCARD.
You may not use the Tesco Home Phone Site for any of the following purposes:
You will be responsible for our losses and costs resulting from your breach of this section 8.
Tesco Telecoms reserves the right to refuse to post material on the Tesco Home Phone Site or to remove material already posted on the Tesco Home Phone Site.
Although Tesco Telecoms aims to offer you the best service possible, Tesco Telecoms makes no promise that the services at the Tesco Home Phone Site will meet your requirements. Tesco Telecoms cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to support@tescohomephone.com and we will attempt to correct the fault as soon as we reasonably can.
If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result and to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order.
Our liability shall not in any way event include business losses such as lost data, lost profits or business interruption.
This section 10 shall not limit or affect our liability resulting from any services provided through the Tesco Telecoms Site being found to be unsafe or if something we do negligently causes death or personal injury.
The Tesco Telecoms Site provides content from other Internet sites or resources and while Tesco Telecoms tries to ensure that material included on the Tesco Home Phone Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If Tesco Telecoms is informed of any inaccuracies in the material on the Tesco Home Phone Site we will attempt to correct the inaccuracies as soon as we reasonably can.
As a convenience to Tesco Telecoms customers, the Tesco Home Phone Site includes links to other websites or material which are beyond its control. Tesco Telecoms is not responsible for content on the Internet or World Wide Web pages on any site outside the Tesco Home Phone Site.
Part of the Tesco Home Phone Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Tesco Home Phone Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.
These Terms and Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with you in any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
Tesco Telecoms makes no promise that materials on the Tesco Home Phone Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Tesco Home Phone Site from territories where its contents are illegal is prohibited.
If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
Please ensure that the expiry date of your payment card is after the anticipated date we will start providing you with the service. Payment is taken at the time we start providing you with the service and in the event that the payment card has expired we will be unable to take payment and provide the service to you.
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
If you breach these Terms and Conditions and Tesco Telecoms chooses to ignore this, Tesco Telecoms will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Tesco Telecoms shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
