Wine Warehouse Product Terms & Conditions

Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you ("Product Terms").

  1. Prices

    The prices payable for the wine that you order are clearly set out in the web site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed in the 'Help' section of the web site.

    Prices from 29th Nov to 5th Dec reflect a minimum of 25% off the non-promotional online case price.

  2. Availability

    If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible.

    Vintage wines are obviously limited in availability. Whilst we make every effort to ensure that the advertised vintage is the one that we deliver, we cannot guarantee which vintage will be shipped to you. However, you are still able to return the wine if you are not satisfied (see 6 below). Your statutory rights are not affected.

  3. Acceptance

    There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods.

    We cannot sell alcoholic products to anyone under 18. For this reason, we may refuse an order at our discretion and orders may not be transferred from the customer to any other person.

  4. Delivery

    Delivery will be made to the address specified by you on the completed order form.

    Please note that we can only deliver wine to selected regions within England, Scotland and Wales.

    We do our best to secure delivery within 30 days of the date of your order but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.

    If for any reason beyond our reasonable control, we are unable to supply a particular wine, we will notify you as soon as possible.

    All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the goods may be retained by the driver, in which case the driver will leave notification of attempted delivery and will telephone to rearrange or will return later that day.

    In these circumstances, if we have to return to deliver the goods, a further delivery charge may become payable.

  5. Cancellation

    You have the right to cancel your order up to 14 working days after the day following the delivery of the goods by using the "Order history" option on the Tesco.com site, or you can call our Customer Services department on 08457 22 55 33. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods to us and we will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given.

    If you do not return the goods within 21 days of your cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the web site. This does not affect your statutory rights.

  6. Returns

    We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.

    Wine bought at the Tesco.Com Wine Warehouse can be returned to your local Tesco store. To arrange this, please contact our customer services department on 0845 7225533.

  7. Payment

    You can pay by any American Express, Mastercard or Visa credit card, Maestro or Delta debit card. We do not currently accept Visa Electron cards.Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.

    You will not be charged for wine until your order is dispatched. If your order is dispatched in more than one delivery, payment for each wine will be taken from your credit/debit card at the point that that wine is dispatched, and our acceptance of each part of the order takes place on dispatch of that wine.

    The cost of your wine includes a 2.5% transaction fee that is payable to Tesco Card Services Limited.

    Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

    We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

  8. General

    These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

    If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
