Tesco Store Finder Satellite Navigation Download Product Terms & Conditions

Please read these product terms and conditions (the "Product Terms") carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the Store Finder Satellite Navigation Download file (the "Download") available to you. These Product Terms apply to the Service in addition to the General Terms and Conditions.

1. The Download

The Store Finder Satellite Navigation Download file (the "Download") is made available to you for download from the Tesco.com website. The Download makes the details of the location of our stores available in a format which can be transferred to compatible satellite navigation devices. The information contained in the Download is based on the Tesco Store Finder which helps you find Tesco stores within the UK and Northern Ireland. The Store Finder lists all larger Tesco stores by the postal district and smaller stores by the nearest town or city.

Although we aim to ensure that the store location information contained in the Download is correct, and we endeavour to update the Download on our website from time to time, we will not be responsible for any errors or omissions.

The Download is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Download you agree to be bound by these Terms and Conditions.

2. Usage

The Download is protected by national copyright, database and trade mark law. The Download is permitted for your personal, non-commercial purposes only. You may download and display the content of the Download on a satellite navigation device or store such content in electronic form on disk (but not any server or other storage device connected to a network).

Any copying, reproduction, lending or hiring, broadcasting or any other form of distribution of the Download is prohibited and will constitute a copyright infringement.

No licence is granted to you in these Product Terms to use any trade mark of Tesco or its affiliated companies including, without limitation, the TESCO trade mark.

3. Technical support

The Download is provided by us without any warranties or guarantees.

We do not provide any technical support for the Download or for transferring the Download information to your satellite navigation device. Please check your satellite navigation manufacturer user guide for details of how to transfer the Download to your device and any technical support offered by the manufacturer.

We do not guarantee or warrant that the Download will be compatible with all satellite navigation devices.

We do not guarantee that the Download will meet your requirements or that the service will be fault free.

We will not be responsible for any errors or omissions or any technical problems you may experience with the Download.

The Download does not include the provision of a computer of other necessary equipment to access the Download. To use the Download you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

4. Liability

We disclaim all liabilities in connection with the following:

To the full extent allowed by applicable law, you agree that we will not be liable to your/or any third party for any consequential of incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Download.

5. General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

We reserve the right to modify, suspend or discontinue the Download (or any part of it) without notice to you and shall not be liable to you if we exercise these rights. You acknowledge that you may no longer be able to replace the Download if we discontinue it and you agree that we shall have no liability to you in that event.
